Terms of Service
**DRAFT — not legally reviewed.** Engineering draft prepared under QONTAI-120. Must be reviewed by qualified legal counsel before publication.
1. Introduction
These Terms of Service ("Terms") govern your use of the QontaineR website and mobile app (together, the "Service") operated by _[TO CONFIRM — legal entity]_ ("we", "us", "our").
By creating an account, you affirmatively accept these Terms and acknowledge that you have read our [Privacy Policy](./privacy-policy.md). Acknowledging the Privacy Policy is not consent to optional processing. Additional terms apply only when you use the relevant feature (for example, the [Subscription Terms](./subscription-terms.md)).
If you do not agree, do not use the Service.
2. Eligibility
You must be at least _[TO CONFIRM — 13 / 16 / 18]_ years old to use the Service. By using it, you confirm you meet that requirement and can enter into a binding contract in your jurisdiction.
3. Your account
• You must provide accurate registration information and keep it up to date.
• One account per person. Do not share your account.
• You are responsible for keeping your credentials safe. We strongly recommend enabling multi-factor authentication.
• You are responsible for all activity under your account. Tell us immediately if you believe your account is compromised.
• We may suspend or terminate your account if you breach these Terms, present a security risk, or misuse the Service.
4. Acceptable use
You agree not to:
• Use the Service for anything unlawful, infringing, defamatory, harassing, obscene, or that infringes another person's rights.
• Attempt to gain unauthorised access to the Service, other users' data, or underlying infrastructure.
• Reverse engineer, decompile, or otherwise attempt to derive source code, except to the extent permitted by law.
• Scrape, automate, or bulk-download data beyond documented API use.
• Use the Service to send spam or malicious content.
• Impersonate any person or entity, or misrepresent your affiliation.
• Interfere with other users' use of the Service.
5. Your content
You own the information you enter into the Service in relation to a scanned or generated QR code (for example, the details of a container, its contents, and any accompanying descriptions, locations, categories, media, or reminders) — together, "Your Content". By using the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, back up, transmit, and display Your Content solely as needed to operate the Service on your behalf.
You are responsible for Your Content and for having the rights to store it.
6. Family sharing
You may create or join a family to share containers with other users:
• The family has three roles:
- **Owner** — manages the family itself, including renaming it, inviting or removing members, changing anyone's role (including transferring ownership), and deleting the family.
- **Member** — can see the family and its shared containers, add their own containers to the family, and update containers they own.
- **Viewer** — has read-only access. Viewers can see the family and any containers shared with it but cannot add, edit, share, or remove anything.
• Removing a member ends their access to shared containers.
• If you own a family that still has other members, both **standard account deletion** and any **right-to-be-forgotten** workflow will be blocked until you either transfer ownership to another member or delete the family. A sole owner cannot leave the family, but they can delete it, which removes it for everyone and takes them out of it in the same step.
7. Premium subscriptions
Optional paid features are governed by the [Subscription Terms](./subscription-terms.md).
8. QR codes
QontaineR QR codes are issued by us and resolve to a URL under our domain. Any QR code you use with the Service must be one issued by QontaineR — do not manufacture, forge, or otherwise attempt to create QontaineR-style QR codes yourself, and do not attempt to use resolver URLs to enumerate or access other users' data. Resolution of an issued code is limited to the account that claimed it.
9. Intellectual property
The Service, including its software, branding, and design, is our intellectual property or that of our licensors. Except for the limited licence to use the Service under these Terms, no rights are granted to you.
10. Third-party services
The Service integrates with third-party services (for example, authentication providers, payment/store providers, transactional email). Your use of those services is subject to their terms and privacy notices.
11. Termination
• You may close your account at any time from within the Service.
• We may suspend or terminate your account for material breach of these Terms, prolonged inactivity, or where required by law.
• Closing your account does not cancel a store subscription. Cancel the subscription with Apple or Google before closing the account.
• On termination, we retain data per the [Privacy Policy](./privacy-policy.md) — some data may be retained for legal, accounting, or fraud-prevention purposes.
12. Disclaimers
We provide the Service with the level of reasonable care and skill required by applicable consumer law. Nothing in these Terms excludes statutory guarantees or remedies that cannot lawfully be excluded.
The Service is a convenience for cataloguing belongings. It is not designed for emergency information, safety-critical reminders, regulated record-keeping, proof of ownership, or the only copy of information you cannot afford to lose. We do not promise uninterrupted availability or that reminders and QR resolution will always be timely. Keep independent records where loss, delay, or inaccuracy could cause harm.
13. Limitation of liability
If you use the Service as a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for avoidable loss caused by relying on the Service for a safety-critical purpose, or for business losses arising from consumer use.
Nothing in these Terms limits liability that cannot be limited under applicable law, including death or personal injury caused by negligence, fraud, or mandatory consumer remedies.
14. Responsibility for misuse
You remain responsible for unlawful content and deliberate misuse of the Service. This clause does not create a broad consumer indemnity or remove any defence or statutory right you have.
15. Changes to the Service
We may change the Service — including adding, removing, or altering features — with reasonable notice where changes are material. We may end the Service with reasonable notice; where you have paid for a subscription, unused prepaid time will be refunded pro rata where required by law.
16. Changes to these Terms
We assign each published version a version number and last-updated date and record when you accept it. Material changes are notified in the app or by email before they take effect. Where acceptance is required, the Service will ask you to review and affirmatively accept the new version rather than treating silence or background use as agreement.
17. Governing law and jurisdiction
These Terms are governed by _[TO CONFIRM — the laws of England and Wales]_. Courts of _[TO CONFIRM]_ have exclusive jurisdiction, subject to any mandatory consumer rights you have in your country of residence.
18. Contact
Draft appendix — engineer notes (remove before publication)
• Confirm entity, contact, jurisdiction, and age gate.
• Align "Termination" and "Your content" sections with the account lifecycle service (soft delete + RTBF).
• Align "Family" clause with family-ownership blocker in `softDeleteAccount` / `anonymizeAccountForRtbf`.
